Disability Lawyers Fight for Your Claim
For those with disabilities,
particularly conditions that prevent them from working, securing the
government benefits that they are entitled to is of the utmost
importance. Unfortunately, there are often legal and administrative
hurdles in getting to that point. Disability lawyers specialize in
navigating the system so that their clients' claims go through as
quickly as possible. One of the most common issues that
disability lawyers and attorneys deal with on a daily basis is Social Security
Disability Insurance, or SSDI. This federal government program
provides monthly payments to those who are younger than retirement
age but still unable to work. The qualifications are as follows, as
specified by the Social Security Administration (SSA): The person must have a physical or
mental condition that prevents engaging in "substantial gainful
activity" The condition is expected to last
for at least 12 months or to result in death The person is under the age of 65 The person has worked for 5 out of
the last 10 years before the onset of their condition (waived if
this was before the age of 22)
The application process is rigorous,
and the most difficult step is usually proving that the applicant is
disabled and unable to work. The time that it takes for an
application to be approved or denied is typically between 3 and 8
months. This backlog is largely due to an increase in the number of
applicants. Statistics from 2005 showed that 34% of applications are
ultimately approved, which leaves a fairly high percent denial rate.
Additionally, the entire process can take years, as many are denied
and must go through an appeal before the application is approved. Attorneys and lawyers who specialize in helping
people through this ordeal represent disabled clients with a wide
variety of conditions. Some of these include: Depression Multiple Sclerosis Fibromyalgia Complex Regional Pain Syndrome
(CRPS) Post-Traumatic Stress Disorder
(PTSD) Anxiety Chronic Fatigue Syndrome (CFS) Carpal Tunnel Syndrome Reflex Sympathetic Dystrophy (RSD) Migraine Headaches Lyme Disease Failed Back Syndrome Chronic Stress Chronic Pain Syndrome Myofascial Pain Syndrome Coronary Dysfunction Cancer Cardiac Impairment Chemical Imbalance Chemical Sensitivity Rheumatoid Arthritis Agoraphobia Vestibular Dysfunction Restless Leg Syndrome Bell's Palsy Bipolar Disorder HIV/AIDS Dercum's Disease High Blood Pressure Temporal Lobe Phenomenon Seizure Disorder Hepatitis Interstitial Cystitis
Demyelinating Disease Diabetes Lupus Congestive heart failure (CHF) Crohns disease Colitis Irritable bowel syndrome (IBS) Inflammatory bowel disease (IBD)
When you find a legal professional you
can trust, they will be able to help you through the entire process
of a disability claim, from advising you on how to fill out an
application, to filing an appeal if needed, and even standing up for
you in front of a judge. Though the search for disability lawyers can
seem daunting, a good place to start is a directory like LegalTube video where you can narrow your search to those lawyers who specialize in this area
of the law.
