Composix Kugel Mesh Patches Cause Major Injuries for Hernia Patients

Hernia Patch Has Defective Recoil Ring Which Can Puncture The Bowel

Hernia repair surgeries are somewhat common, with an estimated 750,000 such procedures performed annually in the U.S. A hernia is a protrusion of tissue or an organ through the membrane in which it is normally contained. The condition can be brought on or aggravated by a number of things, including significant weight loss or gain.

To help surgeons repair the already-fragile tissue around a hernia opening, Davol, Inc. designed the Composix Kugel Mesh Patch. The patch allows the opening to be sealed and the protruding tissue to be held in place without the additional tearing that tight suturing can cause. The patch is surrounded by a patented “memory recoil ring” which allows it to be folded for insertion into a small incision. The implanted patch then springs back into a flat position, effectively sealing the hernia opening.

Unfortunately, the Composix Kugel Mesh Patches have defective rings in some cases, and when these rings break, patients can suffer serious injuries and illnesses. Davol blamed the surgeons who implanted the devices for the problems initially. But growing complaints led to the company sponsoring further testing of the device, which revealed that there was, indeed, a product defect. Testing showed that the memory recoil rings almost always broke at the point at which they were welded together.

The company recalled the Composix Kugel Mesh Patches in the large and extra-large oval shapes. But FDA investigation and criticism soon forced further recalls.

The FDA, a government agency responsible for issuing safety alerts and recalls of defective medical devices, took a closer look at Davol’s production, distribution and safety management. The agency found that there were significant problems with regard to the way the product was made and stored for distribution, and that Davol lacked a sufficient system for tracking and monitoring reports of problems.

The injuries suffered by defective patch recipients include bowel obstructions and perforations, and chronic internal fistulae. These conditions are very serious, and some can be fatal in not detected and treated effectively. Warning signs of these injuries include abdominal pain, fever, usual gastrointestinal symptoms and tenderness at the surgical site. If you received a Composix Kugel Mesh Patch during an inguinal or ventral hernia repair and suffer these or other unusual symptoms, seek prompt medical attention.

Many of the consumers who’ve been injured as a result of a broken mesh patch have taken action against the product’s maker. Individuals are seeking compensation from Davol for the medical costs, additional surgeries, and pain and suffering they’ve incurred. Mesh patch lawyers site the company’s lack of safety controls and delayed recalls as evidence of their negligence and liability. Lawsuits have been filed nationwide, and the number of cases continues to grow.

Many law firms or individual attorneys specialize in a particular type of litigation. Finding the right attorney can be confusing if you don’t know where to start.
