Kugel Mesh Attorneys Fight for Those Injured By Hernia Patch

Injuries May Include Bowel Perforation And Sepsis

Davol, Inc. (a subsidiary of C.R. Bard, Inc.) first introduced the Composix Kugel Mesh Patch in 1997 for use in the repair of ventral (incisional) and inguinal (in the groin area) hernias. In 2002, a growing number of physicians began to report major abdominal injuries in their patients which stemmed from broken memory recoil rings in the patches. The memory recoil ring allows the mesh patch to be folded for insertion into the abdomen. Once correctly positioned, the patch springs back into a flat profile, sealing the hernia opening. Initially, Davol argued that the problem lay with incorrect usage on the part of surgeons and not with the product itself. However, when the company performed further testing of the patches, they found that there was a weakness in the place where the rings were welded together.

This information prompted a recall of the large and extra large oval patches. The FDA soon thereafter looked into Davol’s safety standards and methods of tracking problem reports, and found that the company was not overseeing product safety adequately. The recall of the Kugel Mesh patches was then expanded to include other lot numbers manufactured by Davol.

The Kugel Composix Patches subject to FDA recall include the following:

Among the consumers who received defective patches, the injuries reported have been serious. The broken rings have caused bowel obstruction, bowel perforations and chronic enteric fistulas (abnormal connections between two pieces of intestine). Some of these injuries have advanced to blood infections and other fatal complications. Many patients have required additional surgery to correct the problems, and have sought out Kugel Mesh attorneys to seek compensation for these damages.

Kugel Mesh attorneys began filing lawsuits on behalf of injured parties in 2006, and to date over 2,000 cases have been filed. The lawsuits are an attempt to hold the maker of the defective hernia patches responsible for the tragic consequences faced by these patients.
