Some consumers may also attempt to seek compensation from the drug maker through a class action lawsuit. In a class action suit, similar cases with similar damages are combined to expedite the legal process, and a representative is empowered to negotiate a settlement on behalf of all members of the class. A class must be “certified” by the courts before this type of suit can go forward, however. In many defective drug cases, the court finds that the injuries and damages claimed by the parties involved vary too widely for a class action to be an appropriate legal course.
