NuvaRing Victims File Birth Control Ring Lawsuit

Young Mom Dies Of Blood Clot In Her Lung And Family Is First To File Lawsuit

An increasing number of lawsuits have been filed against the maker of the NuvaRing birth control device by individuals who allege that the product caused injury or death to themselves or a loved one. The injuries claimed by these plaintiffs include amputation, long-term disability, physical and emotional pain and suffering, and wrongful death.

The first birth control ring lawsuit was filed in March 2008 by a New Jersey man, Robert Bozicev, after the death of his 32-year-old wife. Court documents reveal that the woman died after experiencing severe seizures caused by a massive blood clot in her lungs (pulmonary embolism). Bozicev and his lawyers allege that the woman was in perfect health prior to using the NuvaRing in December 2007.

Since that time, scores of additional lawsuits have been filed for injuries or wrongful death related to NuvaRing side effects. To date, more than 37 women have died after suffering health problems related to use of the contraceptive. Hundreds more have incurred serious injuries, with those numbers continuing to climb as more cases are evaluated and filed. The lawsuits contend that drug maker Organon was negligent in its distribution of NuvaRing, in that the company knew about the serious complications associated with its use, but failed to alert the FDA and consumers about the potential dangers.

These cases have been consolidated as of August 2008 under a federal procedure known as Multidistrict Litigation (MDL). This process combines similar pending lawsuits filed in multiple districts and transfers them to a single judge in a single jurisdiction. All birth control ring lawsuits have been transferred to Judge Rodney E. Sippel in the Eastern District of Missouri.

Multidistrict litigation allows complex cases involving common questions of fact to be handled together during pretrial litigation. However, each lawsuit does remain an individual case, and if the litigation is not resolved during pretrial proceedings, each case will be remanded back to the court where they were originally filed for trial.

The serious side effects associated with the NuvaRing device include blood clots, heart attack and stroke.
